Change 2: The New NDIS Act (effective October 3)

Home » Disability and the NDIS » Change 2: The New NDIS Act (effective October 3)

From October 3, 2024, new laws for the NDIS came into effect, following the passing of the National Disability Insurance Scheme Amendment Bill on August 22, 2024. These changes aim to bring the Scheme back to its original purpose and improve experiences for participants and providers.

A New Definition for NDIS Supports

Starting from October 3, 2024, there will be a new definition for NDIS supports. This definition will make it clear to all participants what NDIS funding can and can’t be spent on.

Plans will include a budget amount that can be used for supports, the funding component amounts and duration.

All plans reviewed after October 3, 2024, will have a total budget amount, unlike the line by line supports in current plans. This allows participants to know exactly how much funding they have for supports.

The new scheme also allows greater power for the NDIA to request information, conduct reassessments and make alterations to plans to ensure participants are spending funds appropriately and are meeting eligibility requirements.

The NDIS have stated that most changes won’t be noticed by participants until later in 2025.

A New Definition for NDIS Supports

What does this mean for NDIS Participants?

This means that for some NDIS participants, they will no longer be able to access a support they previously may have used or been able to use. In practice, we have seen a lot more supports coming through as ‘stated supports’ which means that participants are now less able to choose supports within a category as flexibly as they could before the 3rd of October 2024.
